MyCharitySurvey.com and associated brands Charity Choice, The Giving Exchange, Brand Connect and Charity Prime are owned by Datagen Facilities, OPC.

Datagen Facilities, OPC is registered under Registration Certificate No. OPC 20200000521 and is located at 8265J +5PR, South Horizons Business Park, Cabilang Baybay, Carmona, Cavite, Philippines 4116.

We run telephone surveys on behalf of Australian charities and commercial organisations. The surveys are designed to gauge the charitable interests of respondents and to generate leads — that is, to identify people who may be open to further contact from those organisations.

We are not a charitable institution. We act as a service provider to our client organisations.

2. Scope of This Policy

This policy explains how MyCharitySurvey.com and associated brands collects, uses, stores, and shares your personal information. It applies to anyone whose information we hold, including survey respondents, prospective donors, and contacts of our client organisations.

We are committed to complying with the Privacy Act 1988 (Cth), the Australian Privacy Principles (APPs), and the Do Not Call Register Act 2006 (Cth).

3. What Personal Information We Collect

During a survey call, we may collect:

  • Your name
  • Phone number, email address, and postal address
  • Your responses to survey questions, including your charitable interests and preferences
  • Any other information you choose to share during the call

We also receive personal information indirectly — for example, from client organisations or third-party data suppliers — to help us identify and reach appropriate survey respondents.

4. How We Collect Your Information

We collect personal information primarily through outbound telephone surveys. Before any survey begins, we will tell you:

We repeat this opt-out notice at the end of every call. By continuing with the survey after hearing this notice, you are consenting to the collection and use of your information as described in this policy.

5. How We Use Your Information

We use your personal information to:

  • Conduct our survey and record your responses
  • Pass your details to the charities and commercial organisations named in the survey — and to selected third-party organisations — so they can contact you about causes or services that match your expressed interests
  • Help our client organisations maintain and grow their supporter and customer databases
  • Analyse trends and produce statistical reports for our clients. These reports do not identify you individually
  • Communicate with you about MyCharitySurvey.com and our clients, by phone, email, SMS, or post
  • Validate and update the accuracy of the information we hold

We will only contact you — or allow others to contact you — by the channels you have provided. We do not sell your information for unrelated commercial purposes.

6. Who We Share Your Information With

If you express interest during a survey call, we will share your information with:

  • The charities and commercial organisations named in the survey
  • Selected third-party organisations whose activities match your stated interests
  • Our data service providers who help us store, validate, or process information on our behalf

These parties may be located in Australia, New Zealand, the United States, the United Kingdom, Ireland, the European Union, or the Philippines. Where we send your information overseas, we take reasonable steps to ensure the recipient handles it in a way that is consistent with the Australian Privacy Principles.

We do not share your information with any party for a purpose other than those described in this policy.

7. The Do Not Call Register

We comply with the Do Not Call Register Act 2006 (Cth). Before making outbound calls, we check numbers against the Australian Do Not Call Register and exclude registered numbers from our calling lists, except where an exemption applies, such as where you have given us prior express consent to call.

If you are registered on the Do Not Call Register and believe you have received a call from us in error, please contact us immediately at compliance.officer@mycharitysurvey.com.

8. How We Store and Protect Your Information

Your information is stored electronically on secure systems with restricted access, held in controlled facilities. We use a combination of technical and procedural safeguards to protect your information from misuse, loss, unauthorised access, modification, or disclosure. Our staff receive regular privacy training.

Personal information may be stored and processed outside Australia, including in the Philippines. By participating in a survey, you consent to this transfer in accordance with the Privacy Act 1988 and the APPs.

We keep your information only for as long as it is needed for the purposes set out in this policy, or as required by law. When we no longer need it, we will take reasonable steps to destroy or de-identify it.

9. Your Rights

Under the Privacy Act 1988 and the Australian Privacy Principles, you have the right to:

  • Access the personal information we hold about you
  • Request that we correct information that is inaccurate, out of date, incomplete, irrelevant, or misleading
  • Opt out of further contact from us or our client organisations at any time
  • Request that we suppress or delete your details from our database
  • Make a complaint if you believe we have handled your information improperly

12. Business Transfers

If MyCharitySurvey.com or Datagen Facilities, OPC sells or transfers its business assets, the personal information we hold may be transferred as part of that transaction.

We conduct lead-generation surveys on behalf of both charitable and non-charitable organisations to gauge public interest in their causes. We are not a charity.

2. Scope of This Policy

This Privacy Policy explains how Datagen Facilities OPC collects, uses, discloses, and safeguards personal information through our telephone survey programme. It applies to all individuals whose information we handle, including survey participants and people whose details are passed to us by our client organisations.

This policy has been updated to reflect the requirements of the Privacy Amendment Act 2025, in particular Information Privacy Principle 3A (IPP3A), which takes effect on 1 May 2026. IPP3A sets out notification obligations that apply when personal information is collected indirectly — that is, from a source other than the individual themselves.

3. How We Collect Personal Information

3.1 Directly from you

During our telephone surveys we collect personal information directly from you. This includes:

  • Your name and contact details (phone number, email address, postal address)
  • Your charitable interests and preferences
  • Your responses to survey questions about specific causes and organisations
  • Whether you consent to being contacted by specific organisations

3.2 Indirectly — from third parties on behalf of client organisations

We also receive personal information indirectly — that is, from sources other than you directly. In compliance with IPP3A, we are required to notify you of this. Examples include:

  • Contact lists provided by our client charitable and non-charitable organisations, enabling us to conduct outreach surveys on their behalf.
  • Information received from third-party data partners or list providers engaged by our clients.

4. Our Partner Organisation Register

Because the organisations we survey on behalf of change over time — as new charities and non-charitable partners are onboarded and others retire — we maintain a dedicated, publicly accessible Partner Register rather than listing every organisation within this policy. Embedding the full list here would mean reissuing this policy each time the register changes, which would create unnecessary confusion.

  • The full name and contact details of every organisation we currently survey on behalf of
  • A link to each organisation’s own privacy policy
  • A description of each organisation’s sector (charitable, non-charitable commercial, or other)

Why is this kept separate from this policy?

IPP3A requires us to identify the intended recipients of your information as specifically as possible. Maintaining a live web page achieves this better than a static policy document because it can be kept accurate and current at all times. This approach is consistent with the Office of the Privacy Commissioner’s guidance, which allows recipient information to be provided by category or type where naming every party in a single document would be impractical, provided individuals can readily access the full details.

The broad categories of organisations we currently survey on behalf of are:

  • New Zealand-registered charitable organisations (health, welfare, conservation, international aid, and community sectors)
  • Non-charitable organisations with community or social purposes
  • Commercial organisations with related marketing or research interests

These organisations may be located in New Zealand, Australia, the United States, the United Kingdom, Ireland, member states of the European Union, and the Philippines. The Partner Register specifies the location of each.

5. IPP3A — Indirect Collection Notification

In compliance with IPP3A of the Privacy Amendment Act 2025, the following table sets out each statutory notification requirement and how Datagen Facilities OPC addresses it.

6. How We Use Your Information

We use the personal information we collect to:

  • Conduct telephone surveys on behalf of our client organisations;
  • Identify and record your interests in particular charitable and non-charitable causes;
  • Pass your contact details and survey responses to partner organisations you expressed interest in, so they can contact you about supporting their work;
  • Assist our client organisations with audience profiling, database development, and planning;
  • Maintain and improve our survey operations and data quality;
  • Comply with our legal obligations under the Privacy Act 2020 and the Telecommunications Information Privacy Code.

We will not use your information for purposes materially different from those described here without providing prior notification.

7. Disclosure of Your Information

Based on your survey responses, we may share your personal information with:

  • Partner organisations whose questions you responded positively to. The full, current list is maintained at https://mycharitysurvey.com/partners.html, including each organisation’s privacy policy.
  • Our client organisations who engaged us to conduct the survey on their behalf.
  • Third-party service providers who assist with data processing, storage, or survey operations, and who are bound by confidentiality obligations.

Recipients may be located in New Zealand, Australia, the United States, the United Kingdom, Ireland, member states of the European Union, and the Philippines. By participating in our survey, you consent to your information being transferred internationally as described.

We do not sell personal information to unrelated third parties.

8. Your Right to Opt Out

You can opt out of further contact from MyCharitySurvey.com and associated brands and from any of our partner organisations at any time:

9. Data Security and Retention

We take the security of your personal information seriously. We apply appropriate technical and organisational safeguards to protect against unauthorised access, use, disclosure, or loss. These include access controls, secure storage, and confidentiality obligations for all staff and service providers.

Personal information may be stored or processed outside New Zealand, in accordance with the Privacy Act 2020 and applicable international transfer requirements.

We retain personal information only for as long as necessary for the purposes described in this policy, or as required by law. Information no longer required is securely destroyed or de-identified.

While we take all reasonable precautions, no internet or telecommunications transmission can be guaranteed completely secure. We cannot accept responsibility for interception or loss outside our reasonable control.

10. Your Right to Access and Correct Your Information

Under the Privacy Act 2020, you have the right to:

  • Request access to the personal information we hold about you; and
  • Request correction of information that is inaccurate, incomplete, or misleading.

We will respond to requests within 20 working days of receipt. There is no charge for making a request, though a reasonable fee may apply if significant retrieval effort is required.
